Quiky Terms and Conditions

Welcome to Quiky. By accessing or using our platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, as well as our Privacy Policy and Community Guidelines. If you do not agree to these terms, you are not authorized to use Quiky.
1. Acceptance of Terms and Service Agreement
By creating an account, downloading the Quiky application, or accessing our services in any form, you enter into a legally binding agreement with Quiky ("the Platform," "we," "us," "our"). These Terms and Conditions constitute the entire agreement between you and Quiky regarding the use of our services. Quiky reserves the right to modify these terms at any time, with notice provided via email or platform notification. Continued use of Quiky after such modifications constitutes your acceptance of the revised terms. If you do not accept any modification, you may request account deletion in accordance with Section 11 below.
2. Eligibility and Account Requirements
Age Eligibility
You must be at least 13 years old to create an account on Quiky. If you are between 13 and 18 years old, you warrant that a parent or legal guardian has reviewed and consented to these Terms and Conditions and our Community Guidelines. By registering, you represent and warrant that:

You are of legal age to form a binding contract in your jurisdiction

You have authority to enter into this agreement

All information provided during registration is accurate, current, and complete

You are not prohibited from using Quiky by applicable law in your jurisdiction (including Ghana's Cybersecurity Act and Computer Misuse and Cybercrimes Act)
Account Verification
Quiky may require identity verification, including government-issued identification or age verification services, to comply with legal requirements and protect minors from inappropriate content. Failure to complete verification may result in account suspension or termination.
Account Security and Responsibility
You are solely responsible for:

Maintaining the confidentiality of your account credentials

All activity that occurs under your account

Notifying Quiky immediately of any unauthorized access or suspicious account activity

Securing your device and ensuring only authorized persons access your account
Quiky will not be liable for losses resulting from unauthorized account access if you fail to report suspicious activity promptly.
3. Prohibited User Conduct and Content
You agree that you will not, and will not permit others to, use Quiky for any illegal, harmful, abusive, or inappropriate purposes. Prohibited activities include, but are not limited to:
General Conduct Violations:

Posting content that is offensive, abusive, harassing, discriminatory, or defamatory

Engaging in harassment, cyberbullying, or targeted abuse of other users

Impersonating another person, organization, or entity
-
Spamming, including repetitive posting, promotional spam, or phishing attempts
-
Promoting, facilitating, or soliciting illegal activities
-
Engaging in fraud, misrepresentation, or deceptive practices
-
Violating intellectual property rights or copyright protections
-
Collecting or processing personal data without consent
-
Circumventing platform security measures or reverse-engineering platform features
Prohibited Sexual and Exploitative Content
Quiky maintains a strict, zero-tolerance policy toward sexual content. The following are absolutely prohibited:
Sexual Content Definitively Prohibited (All Users):

Any sexually explicit images, videos, or recordings (including AI-generated, animated, or illustrated sexual content such as hentai or deepfakes)
-
Child sexual abuse material (CSAM), including written, photographic, or animated depictions of minors in sexual situations
-
Non-consensual intimate imagery ("revenge porn"), including sexually explicit images or videos shared without consent
-
Sexual solicitation—offering, requesting, or providing methods of contact for sexual encounters, prostitution, or sexual services
-
Sexually explicit language used to solicit or proposition other users
-
Live streams or broadcasts of a sexual nature
-
Sexualized content involving minors, regardless of consent or artistic intent
-
Content depicting sexual violence, rape, or non-consensual sexual activity
All such content violates Quiky's Community Guidelines and applicable laws, including Ghana's Cybersecurity Act and Computer Misuse and Cybercrimes Act.
Enforcement: First detection of sexual content as defined above will result in immediate account suspension (temporary or permanent, depending on severity). Quiky will not issue warnings for sexual content violations—they are treated as serious offenses requiring immediate action.
4. Content Ownership, Licensing, and Acceptable Use
User-Generated Content
You retain ownership of any original content you post on Quiky (text, images, videos, art, etc.). However, by posting content, you grant Quiky a non-exclusive, royalty-free, worldwide, perpetual license to:

Use, reproduce, modify, and publish your content in connection with providing services

Display your content in community features, recommendations, and archive systems
-
Use your content for platform improvements and analytics (anonymized where possible)
You represent and warrant that:

You own or have obtained all necessary rights to post the content

Your content does not infringe on anyone else's intellectual property, privacy, or moral rights
-
Your content complies with all applicable laws and Quiky's Community Guidelines

You have obtained written consent from all identifiable persons depicted in your content
Content Removal
Quiky reserves the right to remove any content that violates these Terms, Community Guidelines, or applicable law. Removal may occur without notice if the violation is serious (such as sexual content, hate speech, or CSAM) or with notice if the violation is correctable.
5. User Conduct Standards and Community Guidelines
Respectful Engagement
Quiky is built on the principle that all users deserve respect. You agree to:

Engage in discussions respectfully, even when you disagree

Not target, harass, or abuse other users
-
Not engage in hate speech, discrimination, or slurs based on race, gender, religion, sexual orientation, disability, or nationality

Respect the privacy and dignity of other users
-
Report violations rather than engaging in public call-outs or vigilante moderation
Misinformation and Harmful Content
While Quiky does not fact-check all content, you agree not to:

Deliberately spread false information known to cause material harm (health misinformation, election interference, fraud)

Create deepfakes designed to defame or deceive
-
Share content that incites violence or harm
-
Spread medical misinformation that could endanger lives
6. Account Suspension, Termination, and Appeal Rights
Quiky operates a tiered enforcement system for violations of these Terms and Community Guidelines:
Warning (First Offense, Minor Violations)
For minor, first-time violations (e.g., single spam post, mild language), Quiky may issue a formal written warning via email describing:

The specific content or behavior in question

How to avoid future violations
-
The consequences of repeated violations
You will have 5 business days to respond or take corrective action.
Temporary Suspension (Repeated Violations or Serious Single Violations)
Quiky may temporarily suspend your account (7-90 days) for:

Repeated violations after warnings
-
Serious single violations (e.g., hate speech, harassment campaigns)
-
Violation of payment terms or fraudulent activity
-
Posting non-consensual intimate imagery or soliciting sexual content
During temporary suspension, your account is inaccessible, though Quiky retains your data.
Permanent Suspension (Sexual Content, Exploitation, Serious Harm)
Quiky will immediately and permanently suspend your account—without warning—for:

Any detection of sexual content as defined in Section 3 (including CSAM, solicitation, explicit material, or deepfakes)
-
Repeated serious violations despite prior suspensions
-
Criminal activity or violation of laws, including Ghana's Cybersecurity Act
-
Creating accounts to evade a prior suspension
-
Activities that pose immediate risk of harm to others
For permanent suspensions, your account will be terminated and all associated content may be deleted. Quiky will retain necessary records for legal compliance and abuse investigation.
Notice and Statement of Reasons
Upon suspension or termination, Quiky will provide you with:

A written notice including the reason(s) for suspension

The specific violation(s) you committed
-
Whether the suspension is temporary or permanent
-
If temporary, the duration of suspension
Appeal Process
If you believe your account was suspended or terminated in error, you may submit an appeal within 30 days of the suspension notice. Appeals must:

Be submitted via [email protected] with the subject line "ACCOUNT APPEAL"

Include your account username and email address
-
Provide a detailed explanation of why you believe the decision was in error
-
Include any evidence supporting your claim (screenshots, context, etc.)
Quiky's Trust and Safety team will review appeals within 10 business days and respond with a decision. Appeals decisions are final. If your appeal is granted, your account will be restored. If denied, you may not appeal the same suspension again.
Note: Appeals for sexual content violations are rarely granted. Permanent suspensions for CSAM or solicitation are not subject to appeal.
Right to Be Heard
Before any permanent suspension, Quiky will provide you with an opportunity to respond to the allegations against you, unless the violation is of such a serious nature (e.g., CSAM) that immediate suspension is necessary to protect users and comply with law.
7. Privacy, Data Protection, and Security
Your privacy is important to us. Quiky does not sell user data to third parties. Please review our Privacy Policy (available at quiky.chat/privacy) to understand:

Quiky is committed to:

8. Intellectual Property Rights
Quiky's Intellectual Property
Quiky, its logo, and all associated intellectual property (including code, design, and proprietary features) are owned by Quiky or licensed to Quiky. You may not:

Reverse-engineer or attempt to extract Quiky's source code

Remove or alter copyright, trademark, or proprietary notices

Use Quiky's intellectual property without explicit written permission

Create derivative works based on Quiky's platform
User Content Rights
As stated in Section 4, you retain ownership of your content. However, content you post must not infringe on anyone else's intellectual property rights. If you post content that violates copyright or other IP protections, Quiky may remove it and your account may be suspended.
9. Liability Limitations and Disclaimers
Service Availability
Quiky is provided "as is" and "as available." Quiky does not guarantee:

Uninterrupted or error-free service

That all features will function at all times

That our servers are secure from unauthorized access

That service will be available in all regions at all times
Quiky may perform maintenance, upgrades, or suspend service at any time without liability. You acknowledge the inherent risks of using online platforms and assume all risk associated with such use.
Third-Party Content
Quiky is not responsible for, and does not endorse, any user-generated content. While Quiky moderates content, we cannot monitor all posts in real-time. If you encounter harmful, illegal, or offensive content, please report it immediately via the in-app reporting feature or email [email protected].
Content Accuracy
Quiky does not fact-check or verify the accuracy of user-generated content. Users are encouraged to think critically and verify information from reputable sources before sharing or relying on it.
Limitation of Liability
To the maximum extent permitted by law, Quiky, its officers, directors, employees, and agents shall not be liable for:

Indirect, incidental, special, consequential, or punitive damages

Loss of data, revenue, reputation, or business opportunity
-
Damages arising from your use of or inability to use the platform
-
Unauthorized access to or loss of personal information
-
Harm resulting from third-party content or conduct
Some jurisdictions do not permit the exclusion of certain damages, so this limitation may not apply to you in full.
10. User Disputes, Moderation, and Reporting
Community Reporting
If you encounter content or conduct that violates these Terms or Community Guidelines, you can:

Use the in-app "Report" feature on specific posts or accounts

All reports are reviewed by trained moderators. Quiky will not disclose to the reported user who reported them.
False or Malicious Reports
Misusing the reporting system by filing false or frivolous reports may result in account warnings or suspension. Do not report content simply because you disagree with it; reports should be based on genuine violations.
User-to-User Disputes
Quiky is not responsible for disputes between users. If you have a conflict with another user:

Do not engage in harassment or public call-outs

Use the block and mute features to limit interaction

Contact support if the other user is violating platform rules
Quiky may facilitate communication for dispute resolution but will not force settlement.
11. Account Deletion and Data Retention
Requesting Account Deletion
You may request permanent deletion of your account at any time by:

Visiting Settings > Account > Delete Account

Emailing [email protected] with the subject "ACCOUNT DELETION REQUEST"

Including your username and confirming your identity
Upon deletion:

Your account will be deactivated immediately

Your public profile and posts will be removed from the platform within 30 days

Your direct messages will be deleted

Some data (logs, metadata) may be retained for legal compliance, fraud prevention, and safety investigations for up to 2 years
Account deletion is permanent and cannot be reversed.
12. Changes to Terms and Conditions
Quiky may modify these Terms at any time. Significant changes will be communicated via email or prominent notice on the platform at least 14 days before taking effect. Your continued use of Quiky after the modification date constitutes acceptance of the updated Terms. If you do not accept changes, you may delete your account in accordance with Section 11.
13. Dispute Resolution and Governing Law
Applicable Law and Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of Ghana and the United States, with Ghanaian law taking precedence for content and conduct matters (including the Cybersecurity Act, Computer Misuse and Cybercrimes Act, and Data Protection Act). Any disputes will be resolved in the courts of Accra, Ghana, or through binding arbitration, at Quiky's election.
Dispute Resolution Process
Before initiating formal legal action, you agree to attempt resolution through:

Mediation: If unresolved after 30 days, both parties may agree to mediation

Arbitration or Litigation: If mediation fails, disputes may proceed to arbitration or court
14. Severability and Entire Agreement
If any provision of these Terms is found to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, or if not possible, it will be severed. The remaining provisions will continue in full force and effect.
These Terms, together with our Privacy Policy and Community Guidelines, constitute the entire agreement between you and Quiky regarding your use of our services.
